Successful Advocacy

Civil SOL Elimination or Extension: As of 2002, Delaware’s civil Statute of Limitations (SOL) was age 21. In 2007 Delaware eliminated the civil SOL going forward (SB 29). In 2010, Delaware also removed the SOL for child sex abuse claims by a patient against a health care provider (HB 326).

Revival Legislation: In 2007, Delaware enacted the Child Victim’s Act, which opened a 2-year revival window for previously expired child sex abuse claims against perpetrators, other individuals, private organizations, and the government (SB 29). In 2010, Delaware removed the SOL for child sex abuse claims by a patient against a healthcare provider and added a 2-year window for these claims, because the original window inadvertently did not apply to actions against healthcare providers (HB 326).

Call Your Lawmakers

Calling your representatives is the most effective way to have your voice heard. Legislative staff track the number of calls they receive on various topics. Just a couple phone calls over a short period of time can bring an issue to the attention of your legislator and raise their awareness of how strongly their constituents feel about a current issue. The sooner you reach out, the more likely it is that your voice will influence their position.

    Staffer: Okay, go ahead.

You: I am calling to express my gratitude on behalf of children and survivors of child sexual abuse in our state for the elimination of the civil statute of limitations for child sexual abuse crimes. I am proud to live in one of the 18 states and US territories to have eliminated the civil statute for some or all child sexual abuse crimes.

However, there is always more work to be done. I urge the Senator/Representative to [discuss your own views on what further measures should be taken to protect children].
